A Special Needs Trust is a discretionary spendthrift trust created for a disabled beneficiary which supplements, but does not replace, public benefits. There are two types of special needs trusts: those created with the beneficiary’s own assets which are referred to as self-settled trusts and those created by someone else with that person’s assets which are referred to as a third-party trust.
