Estate Administration

Estate Administration is the process whereby the Estate’s personal representative gathers all of the decedent’s probate assets, pays any expenses and debts of the Estate, files all appropriate tax returns and pays any appropriate taxes, and ultimately distributes the assets pursuant to the Will if the individual died testate (with a will) or pursuant to state law if the individual died intestate (without a will). Estate administration may also include post mortem estate planning, in order to minimize taxes that may be due, and dispute resolution (through negotiation, arbitration, and litigation).
